| • | All our services are subject to this Terms and Conditions of Business. |
| • | All implied conditions and warranties subject to change or exclusion by Indian Law are hereby excluded from these Terms and Conditions. |
| • | All rates quoted in our Rate Card are subject to change without notice. |
| • | All payments must be made in cash or by bank draft payable at Madras. We reserve the right not to accept cheques. |
| • | Any job done by us remains our property until all dues are settled. Dues that remain unpaid for more than 15 days after completion of a job will be charged interest of 24% per annum. |
| • | Cancellation of booked facilities will be charged at full rate if notice is given less than 24 hours before the scheduled time. Cancellation will be charged at half rate (50%) if notice is given less than 48 hours before the scheduled time. |
| • | Bookings will be charged from the scheduled start time. Delayed starts, the cause of which is attributed directly or indirectly to the customer or his agent, will be charged from the originally scheduled start time. |
| • | We will allow a credit to the customer in the event of equipment malfunction. The credit will be for the amount equal to the chargeable time lost. |
| • | Should the need arise, we reserve the right, without the customer’s consent, to enable sub-contractors to fulfil our obligations to the customers. |
| • | We will not be liable to the customer for any tort committed by us, or any consequential negligence or delays caused to the customer from any cause whatsoever. |
| • | The customer’s material is received, processed or stored by us at the customer’s risk. We shall not be liable for any loss of, or damage to, such material. It is the customer’s responsibility to insure all material supplied to us against all risks. |
| • | While we will take all care to maintain tapes, films and other material in process at our premises, we are not responsible for any loss, accidental or otherwise of jobs in progress. Any liability on our part will be limited to free replacement of equivalent studio time. |
| • | While we will make all attempts to preserve master recordings of our tapes until final release, we will not guarantee maintenance of the material for more than 15 days from the date of the original recording. |
| • | All master tapes will remain our property and will not be released unless specifically requested in writing by the customer directly involved in the production. Dub copies or sub-masters will only be produced on direct authorization by the customer. |
| • | The customer hereby grants us the right to exhibit the customer’s materials for demonstration purposes only. The customer further authorizes us to make duplicates of the customer’s material for the purpose of demonstration only. |
| • | All materials supplied to us will be accepted on the express condition that reproduction of such material will not result in an infringement of copyright, censorship regulations or any other laws by us. |
| • | We shall try to achieve the highest possible standards in the final product but cannot be responsible for poor quality results due to inferior materials supplied by the customer or outside suppliers on behalf of the customer. The customer acknowledges that we cannot guarantee a particular standard or quality on any product beyond the quality of the original materials supplied. |
